Sacbé Moto Adventures – Booking Conditions
INTRODUCTION
These Booking Conditions govern all arrangements made with Sacbé Moto Adventures ("Sacbé Moto," "we," "us," "our") for guided off-road motorcycle adventures and related services ("Tours"). They form the basis of your contract with us and apply to all bookings made directly on our website, by email, WhatsApp, or any other means. Please read them carefully before booking.
1. DEFINITIONS
1.1 "You" or "Customer" refers to the person making the booking ("lead booker") and all persons included in the booking.
1.2 "Tour" means a guided motorcycle adventure package including Aprilia Tuareg motorcycle rental, guide, support vehicle (where applicable), and related services.
1.3 "Services" means any add-on products such as standalone motorcycle rentals, self-guided routes, or itinerary-only planning.
1.4 "Contract" means the legally binding agreement between you and Sacbé Moto once a booking confirmation is issued.
1.5 "Force Majeure" means any event beyond our reasonable control, including (without limitation) acts of God, war, civil unrest, pandemics, volcanic activity, adverse weather, road closures, or government restrictions.
2. FINANCIAL PROTECTION
Sacbé Moto Adventures is a locally registered adventure tourism company in Guatemala. We maintain appropriate insurance and financial safeguards to protect customer payments. In the unlikely event of our insolvency, we will work with our partners to facilitate refunds or alternative arrangements where possible. We strongly recommend that you purchase comprehensive travel insurance that covers trip cancellation, interruption, medical emergencies, and motorcycle-related activities.
3. BOOKING PROCESS AND PAYMENT
3.1 A booking is confirmed once we have received the required deposit and issued a written confirmation (email or WhatsApp).
3.2 For guided Tours, a deposit of 30% of the total cost is payable at the time of booking. The remaining balance is due 45 days before the Tour start date.
3.3 For motorcycle rentals or Services without a guide, full payment is required at the time of booking.
3.4 All payments must be made in USD or the currency stated on your invoice via the methods provided (bank transfer, credit card, or other agreed methods).
3.5 Once your booking is confirmed, the Contract is formed and these conditions apply.
4. BOOKING PROCESS FOR GUIDED TOURS
4.1 After payment of the deposit, you will receive a booking confirmation and a Rider Information Form.
4.2 We will provide a detailed itinerary, packing list, and riding requirements.
4.3 All riders must sign a liability waiver and confirm their riding experience and fitness level before the Tour begins.
4.4 Final participant list and motorcycle assignments are confirmed 30 days prior to departure.
5. RIDING, SAFETY AND RESPONSIBILITIES
5.1 All Tours are led by professional, English/Spanish-speaking guides with extensive local knowledge.
5.2 You are responsible for riding safely, wearing appropriate protective gear (helmet, boots, gloves, jacket, etc.), and following the instructions of your guide at all times.
5.3 Routes are chosen based on current conditions but may change due to weather, road, or safety considerations.
5.4 You must hold a valid motorcycle license appropriate for the engine size of the Aprilia Tuareg and have sufficient off-road riding experience for the chosen Tour level.
5.5 Sacbé Moto provides well-maintained Aprilia Tuareg motorcycles, but you are responsible for any damage caused by negligence, reckless riding, or off-trail deviation. A security deposit will be required.
5.6 You ride at your own risk. Sacbé Moto accepts no liability for injury, loss, or damage arising from participation in the Tour except where caused by our proven negligence.
6. INSURANCE AND DOCUMENTATION
6.1 It is mandatory that you obtain comprehensive travel and medical insurance that specifically covers motorcycle riding, off-road activities, emergency medical evacuation, and repatriation.
6.2 You must carry a valid passport, motorcycle driving license, and any required visas or permits.
6.3 We recommend insurance that covers cancellation due to personal reasons, illness, or force majeure.
7. CHANGES AND CANCELLATIONS BY YOU
7.1 All cancellations must be notified in writing (email or WhatsApp).
7.2 Cancellation charges for guided Tours are as follows:
More than 45 days before departure: Loss of deposit (30%)
45–30 days: 50% of total cost
29–15 days: 75% of total cost
14 days or fewer / no-show: 100% of total cost
7.3 For motorcycle rentals and Services: cancellations made more than 48 hours before the start receive a full refund minus any transaction fees. Less than 48 hours: no refund.
7.4 We strongly recommend travel insurance to cover cancellation charges.
8. CHANGES OR CANCELLATIONS BY US
8.1 We may make minor changes to itineraries for operational, safety, or weather reasons.
8.2 If we must cancel a Tour (except for Force Majeure), we will offer you a full refund or an alternative Tour of equal or greater value.
8.3 We will not cancel a confirmed Tour within 14 days of departure except for Force Majeure or failure by you to pay the balance on time.
8.4 In Force Majeure situations, we will make reasonable efforts to reschedule or provide a partial refund where possible, but we are not obligated to issue a full refund.
9. LIABILITY
9.1 We accept responsibility for providing the services with reasonable skill and care.
9.2 Our liability is limited to the total price paid for your Tour, except where law requires otherwise.
9.3 We are not liable for any loss, injury, or damage resulting from your own actions, third-party services, or Force Majeure events.
9.4 Sacbé Moto is not responsible for any third-party bookings you make independently (flights, additional accommodation, etc.).
10. FORCE MAJEURE
We are not liable for failure or delay caused by events beyond our reasonable control. In such cases, we will assist you as much as possible but cannot guarantee refunds or compensation.
11. DATA PROTECTION
We process your personal data in accordance with Guatemalan data protection regulations and our Privacy Policy. By booking, you consent to us sharing necessary information with our local partners and guides to deliver your Tour.
12. COMPLAINTS
If you have a problem during the Tour, you must notify your guide or our team immediately so we can try to resolve it. Any formal complaint must be sent in writing within 14 days of the end of your Tour.
13. GOVERNING LAW
These Booking Conditions and any disputes arising from them shall be governed by the laws of the Republic of Guatemala, with exclusive jurisdiction of the Guatemalan courts.
